1Agreement to these Terms
These Terms of Use (“Terms”) govern your access to and use of the AskJoy mobile application, the website at askjoynow.com, and all related features and services (together, the “Services”). The Services are operated by AskJoy, a service of BlueTile, LLC, a Delaware limited liability company (“AskJoy,” “we,” “us,” or “our”). “You” means any person who visits, downloads, registers for, or uses the Services.
By creating an account, clicking “I Agree,” or otherwise using the Services, you agree to these Terms and to our Privacy Policy at askjoynow.com/privacy-policy. If you do not agree, do not use the Services.
PLEASE READ SECTION 13 CAREFULLY. IT REQUIRES MOST DISPUTES BETWEEN YOU AND ASKJOY TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT AS DESCRIBED IN SECTION 13.
2Eligibility
To use the Services you must:
- be at least 18 years old and able to form a binding contract;
- reside in the United States; the Services are offered only to US residents;
- use the Services only for your own personal, non-commercial purposes; and
- only connect accounts and subscriptions that you own or are legally authorized to manage.
If you use the Services on behalf of another person, such as a family member, you represent that you have their permission and the legal authority to act for them.
3The Services
AskJoy helps you find, track, and cancel recurring subscriptions and charges. Depending on your plan, the Services may include:
- Subscription monitoring: identifying recurring charges from accounts and inboxes you connect, and showing amounts, renewal dates, and price changes.
- Budgeting: organizing your spending into categories and tracking it against limits you set.
- Alerts: notifications about upcoming renewals, free trials ending, price increases, or new recurring charges, by push, email, or SMS.
- Cancellation assistance: at your request, AskJoy helps cancel a subscription (Section 5).
- Bill negotiation: at your request, AskJoy contacts a provider to try to lower a recurring bill (Section 5). Available only on the paid Plus and Premium plans once they launch.
- Refund requests: at your request, AskJoy asks a provider to refund an unwanted or mistaken charge (Section 5).
- AI assistant: a conversational assistant that answers questions about your subscriptions and can start actions you approve.
Information only, not advice. AskJoy is not a bank, financial advisor, broker, lawyer, or tax professional. Information in the Services is for general organization and convenience, may not fit your situation, and is not financial, legal, or tax advice.
Accuracy. Subscription detection relies on data from third parties and automated analysis. AskJoy may miss a subscription, label a charge incorrectly, or show information that is out of date. You are responsible for reviewing your own statements and confirming what you want to keep or cancel.
AI features. AskJoy uses artificial intelligence to detect subscriptions, chat with you, and in some cases contact providers. AI outputs can be inaccurate or incomplete. Review any summary, recommendation, or proposed action before you rely on it or approve it. AskJoy does not guarantee AI features will be error-free or always available.
Changes and beta features. We may add, change, suspend, or remove features at any time. Features labeled beta, preview, or similar are provided as-is and may not work as expected.
4Your account and connected data
Account. You must create an account and give accurate, current information. Keep your login credentials confidential; you are responsible for activity under your account. Tell us right away at support@askjoynow.com if you suspect unauthorized access. We may verify your identity and may refuse or suspend service if we cannot.
Connecting accounts. You may direct AskJoy to retrieve information from financial institutions, card issuers, email providers, app stores, or other services you use (“Connected Accounts”). We do this through third-party data providers such as Plaid Inc. (“Plaid”) and, if you choose, Google (Gmail) or Microsoft (Outlook). Your use of those providers is also subject to their terms and privacy policies. By connecting a financial account, you also agree that Plaid may collect and process your information under the Plaid End User Privacy Policy. You can disconnect a Connected Account at any time in settings, which may limit the Services.
Email access. If you connect a Gmail or Outlook account, AskJoy accesses only the messages and data needed to find receipts, renewals, and subscription notices. We do not use that data for advertising, and our use of Google data complies with the Google API Services User Data Policy, including its Limited Use requirements. Our staff do not read your email except with your consent, for security, or as required by law. You may revoke access at any time.
Data limits. Data from Connected Accounts is only as current as its last update. AskJoy does not control third-party sites and is not responsible for their errors, downtime, or failure to provide data.
Authorization to access data. You authorize AskJoy and its service providers to access your Connected Accounts and retrieve, store, and use your information for the sole purpose of providing the Services. For that limited purpose, you appoint AskJoy as your agent to access those accounts on your behalf. AskJoy acts as your agent, not as an agent of any third-party provider.
5Cancellation, negotiation, and refund services
What you authorize. When you ask AskJoy to cancel a subscription, you authorize AskJoy, as your limited agent and only for that request, to contact the provider and take the steps reasonably needed to cancel. Depending on the provider, AskJoy may complete the request through its staff, an AI agent, automated scripts, or by giving you step-by-step instructions to finish it yourself. Steps may include calling or chatting with the provider, completing web forms, and sharing account verification details such as your name, email, phone, billing address, account number, and the last digits of your payment card. Where permitted by law and the provider’s terms, AskJoy’s staff, AI agent, or scripts may identify themselves to the provider as the account holder, and you consent to that representation solely to complete your request, including accepting the provider’s standard cancellation terms. AskJoy will log in to a provider account using your credentials only if you give express permission for that specific request in the app. Credentials you share for a request are encrypted and used only for that request and deleted promptly after it closes, no later than 30 days after.
What AskJoy will not do. AskJoy will not open new accounts, make purchases, change plans other than as you request, or move money on your behalf.
Your responsibilities. You must give accurate information, respond to verification requests, and not cancel the same subscription yourself while a request is pending without telling us. You can withdraw a cancellation request any time before it is completed.
No guarantee. Some providers make cancellation difficult or refuse to deal with third parties. AskJoy will use reasonable efforts but does not guarantee any cancellation will succeed or be completed by a particular date. We will tell you if a cancellation succeeds, fails, or needs action from you. Until we confirm, you remain responsible for charges from the provider.
Provider charges. Ending a subscription early may trigger early termination fees, loss of remaining service, forfeited credits, or loss of promotional pricing. These are set by the provider, not AskJoy, and are your responsibility. Cancelling does not by itself entitle you to a refund from the provider. You can ask AskJoy to request a refund (see below), but refunds are at the provider’s discretion.
Bill negotiation. When you ask AskJoy to negotiate a bill, you authorize AskJoy, as your limited agent, to contact the provider and try to lower your rate or keep a promotional rate, on the same permission terms as cancellations above. AskJoy will not change your plan, add services, or sign you up for a new contract term without your approval. Results are not guaranteed, and savings may take 1 to 2 billing cycles to appear. Bill negotiation will be available only on AskJoy’s paid Plus and Premium plans, at the price shown when you subscribe.
Refund requests. When you ask AskJoy to request a refund for an unwanted, duplicate, or mistaken charge, you authorize AskJoy to contact the provider on your behalf to ask for it. Whether to grant a refund is the provider’s decision. AskJoy does not file chargebacks or disputes with your bank or card issuer for you.
Records. We may keep records of cancellation requests, confirmations, and communications with providers to complete the service, show proof of cancellation, and resolve disputes.
6Fees, billing, and auto-renewal
Plans. AskJoy currently offers a free plan. We plan to introduce paid Plus and Premium plans. We will never charge you unless you choose a paid plan and expressly agree to its price, and the rest of this Section applies only once you do. Prices shown in the app at purchase control, and taxes are added where required.
Automatic renewal. Paid plans renew automatically every month at the then-current price, and you authorize us to charge your payment method each month until you cancel. You can cancel any time in Settings > Subscription or, if you subscribed through the Apple App Store or Google Play, through that store’s account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.
Price changes. We will give you at least 30 days’ notice of any price increase before it applies to you, and you may cancel before it takes effect.
Payment. You authorize AskJoy and its payment processor, Stripe, Inc. (“Stripe”), to charge your chosen payment method for all fees and taxes. Card payments are also subject to Stripe’s consumer terms. AskJoy does not store your full card number. If a payment fails, we may retry the charge, pause paid features, or end your plan.
Refunds. If you are not satisfied, you may request a full refund of your first monthly charge within 7 days by emailing support@askjoynow.com. After that, monthly fees are non-refundable and partial months are not prorated, except where required by law or where AskJoy charged you in error. Purchases through Apple or Google are subject to their refund policies.
No paid placements. AskJoy does not sell your personal information, show sponsored offers, or earn affiliate or referral fees from the providers or products shown in the Services.
7Acceptable use
You agree not to:
- connect accounts or request cancellations for accounts you do not own or are not authorized to manage;
- give false information or impersonate anyone;
- use the Services for any illegal, fraudulent, or commercial purpose;
- scrape, crawl, or use bots to access the Services without our written permission;
- reverse engineer, decompile, or try to access the Services’ source code or systems, except as the law allows;
- upload malware or interfere with the Services’ security or operation; or
- harass or abuse AskJoy staff or provider representatives.
8Communications
You agree to receive notices, receipts, and account messages electronically by email or in the app. If you give a phone number and opt in, you agree to receive texts from AskJoy about your account, such as alerts and verification codes. AskJoy never sends marketing texts. Message and data rates may apply; reply STOP to opt out.
9Intellectual property and feedback
AskJoy and its licensors own the Services, including the software, design, text, graphics, and the AskJoy name and logos. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own personal use under these Terms. Third-party names and logos shown in the app belong to their owners and are used only to identify your subscriptions; their use does not mean those companies endorse or partner with AskJoy.
You keep ownership of the information you provide. You grant AskJoy a license to use it as needed to operate and improve the Services, as described in our Privacy Policy. If you send us suggestions or feedback, we may use them without obligation to you.
10Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ASKJOY AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ASKJOY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ALL SUBSCRIPTIONS WILL BE DETECTED, THAT ALERTS WILL BE DELIVERED ON TIME, OR THAT ANY CANCELLATION WILL SUCCEED.
Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
11Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ASKJOY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR CHARGES BILLED BY THIRD-PARTY PROVIDERS, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. ASKJOY’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED $500 (FIVE HUNDRED US DOLLARS).
Some jurisdictions do not allow these limits, so they may not fully apply to you.
12Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless AskJoy and its officers, directors, employees, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Services, or information you provided that was false or that you were not authorized to provide.
13Dispute resolution and arbitration
Informal resolution first. Before filing a claim, you and AskJoy agree to try to resolve the dispute informally. Send a written notice describing the issue and the relief you want to legal@askjoynow.com. If it is not resolved within 60 days, either party may proceed.
Binding arbitration. Except for claims that qualify for small claims court and requests for injunctive relief over intellectual property, any dispute relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. Arbitration may be held by phone, video, or in the county where you live.
Fees. Payment of filing and arbitrator fees is governed by the administrator’s consumer rules.
Class action waiver. YOU AND ASKJOY EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. YOU AND ASKJOY EACH WAIVE THE RIGHT TO A JURY TRIAL.
Opt-out. You may opt out of this arbitration agreement by emailing legal@askjoynow.com within 30 days after first accepting these Terms, from the email on your account, stating that you opt out of arbitration.
Severability. If the class action waiver is found unenforceable, this entire Section 13 will not apply, and disputes will proceed in court as described in Section 14.
14Governing law and venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any claim not subject to arbitration will be brought in the state or federal courts located in Clark County, Washington, and you and AskJoy consent to their jurisdiction.
15Termination
By you. You may stop using the Services and delete your account at any time in Settings > Account > Delete Account or by emailing support@askjoynow.com. Deleting the app or your account does not cancel a paid plan bought through Apple or Google; cancel it in that store. Pending cancellation requests may stop when you delete your account.
By AskJoy. We may suspend or end your access if you breach these Terms, if required by law, or if we discontinue the Services. Where reasonable, we will give notice. Sections that by their nature should survive (fees owed, intellectual property, disclaimers, liability limits, indemnity, and dispute resolution) survive termination.
Your data. After account deletion, we will delete or de-identify your personal information as described in our Privacy Policy, except where we must keep it for legal, security, or dispute purposes.
16App store terms
If you downloaded AskJoy from the Apple App Store or Google Play, these Terms are between you and AskJoy only, not Apple or Google. AskJoy, not the store, is responsible for the app, its support, and any claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not in a country subject to a US embargo and are not on any US government restricted-party list.
17Changes to these Terms
We may update these Terms from time to time. We will post the new version with an updated effective date and, for material changes, notify you by email or in the app at least 30 days before they take effect. If you keep using the Services after changes take effect, you accept them. If you do not agree, stop using the Services and cancel any paid plan.
18General
These Terms and the Privacy Policy are the entire agreement between you and AskJoy about the Services. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
19Copyright complaints
If you believe content in the Services infringes your copyright, send a notice meeting the requirements of the Digital Millennium Copyright Act to our designated agent: AskJoy Legal, legal@askjoynow.com.
